III Website

1. What data is processed and for what purpose?

Informational use

When using our website for informational purposes, we collect, store and process personal data. When you visit our website, a so-called log file (server log files) is stored temporarily and anonymously on our web server. This consists of:

  • the page from which the page was requested (known as the referrer URL)
  • the name and URL of the requested page
  • the date and time of the call
  • the description of the type, language and version of the web browser used
  • the IP address of the requesting computer, which is shortened in such a way that it is no longer possible to establish a personal reference
  • the amount of data transferred
  • the operating system
  • the message indicating whether the call was successful (access status/HTTP status code)
  • the GMT time zone difference

The temporary storage of data is necessary for the duration of a website visit in order to enable the website to be delivered. Further storage in log files takes place to ensure the functionality of the website and the security of the information technology systems. These purposes also constitute our legitimate interest in data processing.

2. Legal basis

The data is processed for informational use of the website on the basis of Art. 6 (1) (f) GDPR.

3. Recipients of the data

The website is hosted by mobilistics GmbH, Hohe Straße 102, 44139 Dortmund, Tel. +49 231/586914-0, info@raphael-gmbh.de. The host receives the above-mentioned data as a processor.

4. Storage period

The data will be deleted as soon as it is no longer required for the purpose for which it was collected. In the case of the provision of the website, this is the case when the respective session has ended. The log files are stored for a maximum of 24 hours and are accessible directly and exclusively to administrators. After that, they are only available indirectly via the reconstruction of backup tapes and are finally deleted after a maximum of four weeks.

IV Contacting us

1. What data is processed and for what purpose?

When you contact us by email or via the contact form, the data you provide there (e.g. surname and first name, address, email address and the time of transmission, your request and your message) will be processed for the purpose of handling your enquiry.

2. Legal basis

The legal basis is Art. 6 (1) sentence 1 lit. b or lit. f GDPR as well as Art. 6 (1) lit. a GDPR.

3. Recipients of the data

Within our company, only those departments that need your data to process your enquiry will have access to it.

4. Storage period

We delete the data collected in this context if the enquiry is assigned to a contract after the contract term has expired, otherwise after storage is no longer necessary, or restrict processing if there are legal retention obligations.

V Video surveillance

1. What data is processed and for what purpose?

We record images in our administrative building. The images are recorded in order to prevent and investigate burglaries, thefts, vandalism and other violations of the law.

2. Legal basis

The legal basis for the processing of your personal data is Art. 6 (1) (f) GDPR. According to this, the processing of data is permissible if it is necessary for the protection of property and personal safety. Our legitimate interests in this case are the preservation of evidence for the enforcement of legal claims, the prevention and prosecution of criminal offences, and the enforcement of domestic authority.

3. Recipients of the data

Internally, only employees entrusted with processing the data have access to the recordings and your data. In the event of a suspected criminal offence, the recordings may be passed on to law enforcement authorities. For legal and criminal prosecution purposes, the recordings may also be passed on to other parties such as experts, lawyers and other legal representatives and courts as evidence. The data is transmitted exclusively on a confidential basis and is only accessible to persons who are required to know it for the specified purpose.

4. Storage period

In principle, your personal data will only be stored for as long as is necessary to pursue the purposes stated above. The standard storage period is 72 hours. In the event of a specific suspicion, storage for a longer period of time is possible for the purpose of clarification.  This may be deviated from if specific events (e.g. damage to property, theft or burglary) require longer storage for the purposes mentioned above (e.g. preservation of evidence or assertion of civil law claims). In this case, the data will be stored for the duration of the assertion and clarification of legal claims.

VI Your rights as a data subject

1. Right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Article 6(1)(f) GDPR. The objection can be made informally and should be addressed to: GLA Global Logistics & Analytics Gesellschaft mbH, Henry-Everling-Straße 1, 59174 Kamen, datenschutz@tedi.com. The controller will then no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims. The collection of data for the provision of the website and the storage of log files are essential for the operation of the website.

2. Right of withdrawal

In accordance with Art. 7 (3) GDPR, you have the right to revoke your consent at any time. This revocation can be made informally and should be addressed to: GLA Global Logistics & Analytics Gesellschaft mbH, Henry-Everling-Straße 1, 59174 Kamen, datenschutz@tedi.com. The controller will cease processing the data from the moment the revocation is received, provided that the processing was based solely on consent. The processing that took place until the revocation on the basis of valid consent remains lawful.

3. Other rights of data subjects and right to lodge a complaint

In accordance with Art. 15 GDPR, you have the right to obtain information about the data stored about you. If incorrect personal data has been processed, you have the right to rectification in accordance with Art. 16 GDPR. If the legal requirements are met, you can request the erasure or restriction of processing and object to data processing (Art. 17, 18 and 21 GDPR). According to Art. 20 GDPR, you can assert your right to data portability for data that is processed automatically on the basis of your consent or a contract with you. These rights can be asserted against GLA Global Logistics & Analytics Gesellschaft mbH, Henry-Everling-Straße 1, 59174 Kamen, datenschutz@tedi.com. If you believe that data processing violates data protection law, you have the right to lodge a complaint with a data protection supervisory authority of your choice (Art. 77 GDPR in conjunction with Section 19 BDSG). This also includes the data protection supervisory authority responsible for us: State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia, www.ldi.nrw.de.
